Promotion Title: NESCAFÉ “POINTS”
Promotion Period: 21 June 2011 until 31 December 2011

QUALIFICATIONS/DISQUALIFICATIONS OF PARTICIPANTS:
  1. Open to Filipino citizens or person residing in the Philippines for at least a year, at least 18 years of age at the time of joining.
  2. Nestlé Philippines, Inc. (NPI), MRM Worldwide, Publicis Manila, Inc., (the “organizers of the promotions”) and other official media partners and sponsors' employees and their relatives up to the fourth degree of consanguinity are disqualified from joining.
  3. By joining and participating in NESCAFÉ “POINTS” promotion (the “promotion”), those qualified and interested to join the promotion (the “participant”) confirm, agree to and acknowledge that:
    1. He or she has read the full mechanics of this promotion and agrees to abide by the terms and conditions of the same;
    2. NPI is permitted to receive his or her registration data and that all personal information supplied by him/her will be used by NPI in accordance with its privacy policy;
    3. Organizers of the promotions have the right to identify him or her as a participant or a winner in the promotions and communicate the same at any time in any territory through any medium of release (mass media, digital media, etc.);
    4. He or she shall hold organizers of the promotions free and harmless from any and all claims, suits and actions for damages or liabilities that may be brought by other persons, natural or juridical, in connection with his/her participation in this promotions as well as the statements and declarations made by his or her in relation to the promotions;
    5. Organizers of the promotions may, without further compensation to his or her to: (a) to reproduce, distribute, adapt, modify, make available and/or communicate to the public, exhibit, or broadcast any material or information regarding this promotion by any means or media without restriction of any kind as to quantity, purpose or time, whether commercial or otherwise, or to any country or territory in the world; and (b) authorize any of the above activities;  
    6. Organizers of the promotion shall not be liable for any unauthorized use, reproduction and adaptations by third parties of any material or information regarding this promotion; and
    7. He or she shall make no reproduction of any part of the website/s accessed by him or her pursuant to this promotion for purposes of selling or distributing the same for commercial gain nor shall he or she modify or incorporate any part of said websites in any other work, publication or website.
  4. Promotion period is from 01 June 2011 until 31 December 2011.
  5. DESCRIPTION OF PROCEDURES:

    A. How to Join:

  6. Participants must register to join the promotion by going to the NESCAFÉ “POINTS” Facebook application (the “promotion app”) found on the NESCAFÉ Philippines Page on Facebook (http://www.facebook.com/nescafe.ph).
  7. Inside the promotion app, participants will be asked to register their complete name, birthday, mobile number and valid email address and read and agree to abide by the full mechanics of the promotion before they can join the promotion.
  8. The NESCAFÉ Philippines Page on Facebook (http://www.facebook.com/nescafe.ph) is provided on an "As Is" and "As Available" basis and NPI gives no warranties of any kind, whether express, implied, statutory or otherwise including warranties or representations that materials found on the links therein, including those provided by the participants will be complete, accurate, reliable, timely, non-infringing to third parties; that access to the links found therein, including those provided by the participants will be uninterrupted or error-free; that the links found therein, including those provided by the participants will be secure; that any advice or opinion obtained from links found therein, including those provided by the participants, is accurate or to be relied upon and any representations or warranties thereto are expressly disclaimed.
  9. B. How to Participate in the Promotions

  10. The promotion awards certain number of points to participants for the following acts done on the promotions app (the “participation”), subject to terms and conditions under this promotion mechanics:

    Valid participation in other on-line promotion for NESCAFÉ conducted third-party applications featured in the NESCAFÉ Philippines Page on Facebook (http://www.facebook.com/nescafe.ph) from 01 June 2011 until 31 December 2011

    Mechanics for participation subject to the separate promo mechanics for each promotion
  12. Organizers will keep a record of the points earned by participants during the promotion period in its own independent database. The points will be recorded as soon as participation is deemed valid based on the rules set for each participation. Participants may inquire about the points earned by logging on to the promotion app.
  13. A participant can do an act of participation (as described above) only once. A maximum of 40 points can be credited to a participant for valid participations during the promotion period.
  14. During the duration and at any stage of the promotion, organizers of the promotion may disqualify participants who fail to qualify with the qualifications specified in these mechanics and their decision on the matter is final.
  15. DESCRIPTION OF WINNERS: C. How to use Points:
  16. For a certain number of points earned, participants may be entitled to redeem certain items that will be described and listed in the promotion app. Redemption may be done on-line through the promotions app. Participants will be asked to provide certain information related to the redemption in the promotion app.
  17. D. How to Redeem Item/s
  18. The requirements for redemption, deadline for redemption and other mechanics shall also be announced at the promotion app at least seven (7) days prior to the opening of redemption for said items. Any redemption of item/s under this promotions shall, however, be subject to all of the following conditions:
    1. Accumulation of sufficient number of points;
    2. Possession of all the qualifications and none of the disqualifications set forth in these mechanics;
    3. Proper verification of the identity of the participant and the validation of the points earned;
    4. Approval by the organizers of the promotions of the redemption;
    5. Availability of the item/s being claimed from the organizer of the promotions’ inventory; and
    6. Compliance with all the terms and conditions set forth in these mechanics.
    A participant may redeem more than one item but is not allowed to redeem an item more than once, provided that he or she complies with the foregoing requirements.
  19. Upon receipt of the electronic redemption form, organizers of the promotion will verify whether or not the person who submitted the form belongs to the registered participants to the promotions. If he/she is not, the form is considered as not submitted and no further action shall be taken thereon.

    Electronic redemption forms received after the announced deadline for the submission of said forms will be considered as not submitted. An email notification on this regard shall be sent to the participant in the email address provided in the form. The decision of the organizers of the promotion on this regard is final.

    Once the electronic redemption form has been sent by the participant, the redemption form can no longer be changed, transferred or cancelled.
  20. If the person who is making the redemption belongs to the registered participants to the promotion, organizers of the promotion shall validate whether the points he or she claims to have been earned by him or her is accurate based on its own database. In case of discrepancy between the points specified in the redemption form and that which is reflected in the database, the points reflected in the database shall prevail.  The decision of the organizers of the promotion on this regard is final. In this case, organizers of the promotion shall send an email to the participant (through the email address provided in the promotion app) about the discrepancy and inform him or her whether or not he or she has earned sufficient points to entitle him or her to the item being redeemed.
  21. If there is no discrepancy between the points claimed and the points recorded in the database, the person who is making the redemption will be informed that the item/s to be redeemed shall be made available to him or her at the McCann Worldgroup Philippines (MRM Worldwide) Office located at 34/F GT Tower, 6813 Ayala Avenue Makati City, Metro Manila, from Monday to Friday, during office hours, within thirty (30) calendar days from the sending of the email notification to the participant in the email address provided in the promotion app and shall remain available in said office for sixty (60) calendar days from the time the items are made available in the said office (the “redemption period”).
  22. Item/s available for redemption shall be given on a first-come, first-served basis. If the item/s sought to be redeemed is/are no longer available, the participant may use the points earned to redeem item/s in the next round of redemption to be announced in the promotion app. The points accumulated under this promotion, however, shall remain valid for redemption only within the promotion period indicated in these mechanics.
  23. During the claiming of the item/s to be redeemed, the participant must present a print out of email notification sent to him or her and at least two valid IDs, with at least one containing his or her recent photograph. If the participant has indicated in his or her form an authorized representative to redeem the item/s on his or her behalf, the authorized representative must present a print out of email notification sent to participant, valid ID of the participant and his or her (authorized representative) own ID before the item/s will be released to him or her.
  24. In relation to the abovementioned paragraph, if the participant or his or her duly authorized representative do not personally claim the item/s sought to be redeemed within the redemption period, the item/s to be redeemed shall be forfeited in favor of NPI, upon FDA approval.  The decision of NPI on this regard is final. 

    Once claimed and in the possession of the participant, all risks to the item/s redeemed shall be vested on the participant.
  25. The descriptions of the item/s that can be redeemed under this promotion are based solely on information provided by third party manufacturers or suppliers. Photographs of item/s appearing in the promotion app may slightly differ from the actual items.
  26. With regard to the reliability of the quality and functionality of the item/s that can be redeemed under this promotion, organizers of the promotions rely on the representations made by manufacturers or suppliers of these items. In some cases, certain items may be covered by manufacturer’s warranty so participant should direct his or her inquiries to the manufacturer or supplier in accordance with the warranty information of the item/s so redeemed.
  27. The points accumulated under this promotion shall remain valid and effective only during the promotion period indicated herein.
  28. All points earned under this promotion are not transferable and not convertible to cash.
  29. A participant is not allowed to pull, merge or combine his or her points with other participants in order to be entitled to redeem item/s under this promotion.     
  30. All items to be redeemed under this promotion shall be given tax-free.
  31. NUMBER OF WINNERS/CATEGORIES/NO. OF TIMES A PARTICIPANT MAY WIN:
  32. The number of participants who will make valid redemptions is dependent on the number of points earned and the mechanics for redemption set and announced for each redemption round during the promotion period.
  33. PROCEDURE IN THE NOTIFICATION OF WINNERS:
  34. Redemption will take place upon the initiative of the participant and upon on-line redemption through the promotion app. Upon validation and verification, participants with valid redemptions will be sent email notification that the item/s to be redeemed shall be made available at the McCann Worldgroup Philippines (MRM Worldwide) Office located at 34/F GT Tower, 6813 Ayala Avenue Makati City, Metro Manila, from Monday to Friday, during office hours, within thirty (30) calendar days from the sending of the email notification to the participant in the email address provided in the promotion app and shall remain available in said office for sixty (60) calendar days from the time the items are made available in the said office (the “redemption period”).
  35. OTHER GUIDELINES:
  36. Organizers of the promotion assume no responsibility for:
    1. Any incorrect, inaccurate or incomplete information on the websites herein caused by any third party, i.e., website users, hackers, among others, or caused by any of the equipment or programming associated with or utilized in the promotion.
    2. Any statement, comment or declaration posted or submitted to the NESCAFÉ Philippines Page on Facebook (http://www.facebook.com/nescafe.ph). Said statements, comments or declarations are those of the participants or members of said Facebook Fan Page and not of the organizers.
    3. Any technical, hardware or software failure of any kind, for lost network connections, garbled computer transmissions, and other problems or technical malfunctions in the conduct of this promotion.
    4. Any error, omission, corruption, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, or unauthorized access to or alteration of the email addresses, and Facebook accounts used in this promotion.
    5. Any error, omission, corruption, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorized access to or alteration of submissions of the contestants under this promotion or other similar instances that may occur in connection with or in relation to this promotion.
  37. NPI, its parents, affiliates, subsidiaries and related companies or its officers, directors, employees, shareholders, representatives or agents shall not be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential, special or punitive damages arising out of any access to and use of the NESCAFÉ Philippines Page on Facebook (http://www.facebook.com/nescafe.ph). Without limiting the generality of the foregoing, everything on the foregoing websites herein are provided “as is”, without warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for purpose or use or non-infringement.
  38. Organizers of the promotion shall be entitled to cancel, discontinue or suspend this promotion on the basis of the occurrence of force majeure or any event beyond the control of the organizers of the promotion that will not make it possible for them to continue with the conduct of the promotion without affecting the fairness and integrity of the same, including but not limited to the following:
    1. programs are not capable of running as planned, including infection by computer virus, bugs, tampering;
    2. unauthorized intervention;
    3. technical failures;
    4. technical malfunction of any telephone network or lines, computer on-line systems, servers, computer equipment and software;
    5. failure of any e-mail account to transmit message to the organizers on account of technical problems, human error or traffic congestion on the internet or any website;
    6. injury or damage to the participant’s or any other person's computer due to or resulting from participating in the promotion or downloading any materials from the Facebook website; or
    7. any other causes which corrupt or affect administration, security, fairness, and integrity of selecting the participants in this promotion.

The decision of the organizers to cancel, discontinue or suspend this promotion on the basis of the foregoing is final and they will not engage into any dialogue with any person regarding such decision.
